DE GUZMAN LEGAL

Immigration

We help with various visas for both onshore and offshore migrants to travel to or stay in New Zealand (or both).

We are an authority on the New Zealand immigration law and policy. We may also assist New Zealand employers and residents who may want to sponsor migrants.

The 2 main New Zealand immigration visas are a temporary entry class visa and a permanent visa. Depending on your visa type, New Zealand permits the migrant to stay in the country legally for different purposes – visit, work, study or to live permanently.

Work Visa (WV)

A work visa allows a migrant to legally work for a New Zealand employer. There are various types of work visas ranging from Accredited Employer Work Visa, Working Holiday Visa, and Post-Study Work Visa. Our work visa application service also includes aid to New Zealand employers.

Variation of Conditions (VOC)

Your New Zealand work/student/visitor visa contains conditions. You need to apply for the VOC if you are changing the condition/s of your temporary visa. You must first obtain approval from Immigration New Zealand for appropriate new conditions in order to continue lawfully working in NZ.

Partnership Work Visa

This is a visa application where an eligible party to a relationship wants to sponsor a spouse/partner and obtain working rights in New Zealand.

Dependent Child/Children under a Student Visa

This visa applies to a migrant who has a qualifying dependent child wanting to come to New Zealand under a student visa.

Skilled Migrant Category (SMC) Visa

Also known as the ‘Points System’, SMC is one of the main pathways towards residency where a migrant wants to live, work and/or study in New Zealand indefinitely.

The SMC visa application is based on points system. Different criteria correspond to points. The criteria include qualification, work experience, age, skilled employment etc. For you to get an idea of how many points you can claim, a link to calculating your points is given below, but we can guide you for an assessment.

The stages for the SMC visa application are as follows:

W

Expression of Interest (EOI)

An online submission similar to the online points indicator. You will need at least 100 points to be accepted in the pool. Ideally, you must have 160 points or more for an automatic invitation to residency from Immigration New Zealand.

W

Invitation to Apply

The ‘selection process’ usually happens fortnightly. Once the submitted EOI application is selected, checked and met the threshold, Immigration New Zealand may invite you to apply for residence. You must submit the original documents evidencing what was declared in the EOI within 4 months from the date of invitation to prove the claim.

Partnership Resident Visa

This visa application suits those migrants who wish to live permanently in New Zealand with their spouse/partner who holds a resident class visa or is a citizen. A discounted fee applies if your partnership work visa is obtained through us.

Student Visa

The initial consultation fee is included in the total cost if/when you engage us on your student visa application.

Potentially Prejudicial Information (PPI)

During the processing of your visa application, you may receive a letter from an immigration officer about a concern on your application. This is called “Potentially Prejudicial Information” (PPI) letter. It is a notice from Immigration NZ identifying information which may have a negative effect on the result of your application. We can help you identify the main issue and respond to the letter, properly addressing the query to satisfy the immigration officer.

Section 61 Request

Section 61 of the Immigration Act provides an avenue for people who are in New Zealand ‘unlawfully’ to get back onto a lawful state by having a valid visa. We can assist overstaying migrant/s to come up with the solutions required.
